Terms of Service

These terms are an agreement between you and Rakan Systems covering your use of RevRadius, including the website and the application. By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to do so, and “you” refers to that company.

RevRadius helps you score, tier, and prioritize the partners in your ecosystem. It is a decision-support tool. It is not a system of record, and it is not a substitute for your own commercial judgement.

RevRadius is currently pre-release. Features may change, and the service may be unavailable at times while we develop it. We will not make backwards-incompatible changes that destroy your data without giving you notice and a way to export it.

You are responsible for activity under your account and for keeping your sign-in credentials secure. Accounts belong to an organization, and an organization administrator can add, remove, and change the permissions of members. If you are added to an organization, its administrators can access the data in that organization, including data you enter.

Tell us promptly if you believe an account has been accessed without authorization.

You own the information you enter or import into RevRadius. You grant us only the licence needed to host, process, and display it in order to provide the service to you.

We do not sell your data. We do not use it to train general-purpose AI models, and we do not make it available to other customers. Processing is described in the Privacy Policy.

You are responsible for having the right to provide the information you put into the service, including where it relates to identifiable people, and for complying with the law that applies to you when you do so.

RevRadius generates scores, tiers, activation gaps, and partner suggestions, some of which are produced using artificial intelligence. These outputs are estimates. They can be incomplete, out of date, or wrong.

They are provided to support your decision-making, not to replace it. You should not rely on them as the sole basis for any commercial, financial, contractual, or employment decision, and you remain responsible for decisions you make using the service. You can override any generated score.

Do not use RevRadius to break the law, infringe anyone's rights, or store information you are not entitled to hold. Do not attempt to gain unauthorized access to the service or to another organization's data, interfere with its operation, scrape it in bulk, or resell access without our agreement. Do not use it to build a competing product.

We may suspend access where we reasonably believe these terms are being breached, or where continued access poses a security or legal risk. Where practical we will tell you first.

RevRadius does not currently charge a fee. If we introduce paid plans, we will give notice before charges apply to you and you will be able to decline by discontinuing use.

We own RevRadius, including the software, the RADIUS framework and its scoring methodology, and all associated branding. Nothing in these terms transfers that to you. You may not copy or reproduce the framework or methodology for use outside the service without our written permission.

If you send us feedback or suggestions, we may use them without restriction or obligation to you.

RevRadius relies on third-party infrastructure and may connect to other tools you use. We are not responsible for third-party services, and your use of them is governed by their own terms.

You can stop using the service and close your account at any time. We may terminate or suspend access if you breach these terms, or if we discontinue the service, in which case we will give reasonable notice and an opportunity to export your data.

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error free, or that generated scores will be accurate.

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or relating to these terms or the service.

Our total liability arising out of or relating to these terms will not exceed the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred US dollars.

Nothing in these terms excludes liability that cannot be excluded under applicable law.

We may update these terms as the service develops. When we make a material change we will update the effective date above and give notice through the service or by email. Continuing to use RevRadius after a change takes effect means you accept the updated terms.

These terms are governed by the laws of the State of Texas and the federal laws of the United States applicable there, without regard to conflict of law principles.

The state and federal courts located in the State of Texas have exclusive jurisdiction over any dispute arising out of or relating to these terms or the service, and both parties consent to venue in those courts.
